1. Who we are
Kalima ("Kalima", "we", "us") runs the learning platform at kalima.academy: this website, and the learning environment where your sessions, materials and certificates live. The service is operated by [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS] under registration number [REGISTRATION NUMBER].
By using the platform you accept these terms. If you do not accept them, please do not use it. These terms apply alongside our privacy policy.
2. Accounts
You cannot open an account yourself. Accounts are created by our team after you send a request through the form on our home page, and we may decline a request without giving a reason.
- Keep your password confidential. You are responsible for what happens through your account.
- Tell us at [SECURITY EMAIL] as soon as you think someone else has access to it.
- Accounts are personal: do not share your login, and do not send someone else to a session in your place without telling us first.
- You must be at least [MINIMUM AGE] years old. A younger learner may use the platform only through an account requested and supervised by a parent or guardian, who accepts these terms on their behalf.
- Keep the details on your account accurate — we use them to reach you about your sessions.
You may close your account at any time by writing to us. We may close or suspend an account that breaches these terms, and we will tell you why when we do.
3. Sessions and bookings
Kalima is a one-to-one tutoring service. Once your account exists we match you with a tutor, and you agree session times together through the platform. Sessions take place online, and a session is booked only once it appears in the platform — a message about a possible time is not a booking.
Tutors are engaged by us to teach; they are not your employees and you are not theirs. We choose who teaches you, and we may change your tutor where we have to, telling you before we do.
A certificate records that you completed a learning plan agreed with your tutor. It is issued by Kalima and is not a formal academic qualification unless we state otherwise in writing.
4. Cancelling and refunds
- You cancel or move a session. Tell your tutor at least [N] hours before it starts and it is rescheduled at no cost. Later than that, the session may be treated as taken.
- You do not turn up. If you have not joined within [N] minutes of the start and we have heard nothing, the session may be treated as taken.
- Your tutor cannot attend. We reschedule the session or refund it — your choice.
- You stop your plan early. Sessions you have paid for but not taken are refunded, less any session already delivered. Write to [CONTACT EMAIL] to arrange it.
- Refund method and timing. Refunds go back to the payment method you used, within [N] days of us agreeing them.
If you are a consumer in [JURISDICTION], you may also have a statutory right to cancel within [N] days of buying. Where you ask us to start sessions inside that window, you may owe us for what has already been delivered. [CONFIRM LOCAL CONSUMER RULES]
5. Fees and payment
What you pay, how often, and by which methods is agreed with you before your first paid session and set out at [PRICING AND BILLING TERMS]. Fees are stated in [CURRENCY] and [INCLUDE / EXCLUDE] applicable taxes. If a payment fails we may pause your bookings until it is settled. We may change our prices, but never for sessions you have already paid for, and we will give you [N] days' notice before a change affects you.
6. Acceptable use
While using the platform, please do not:
- harass, threaten or discriminate against a tutor, a member of staff or another learner;
- record a session without the clear agreement of everyone in it;
- copy, resell or republish course materials, or share them outside the platform;
- probe, overload or interfere with the platform, or try to reach parts of it you were not given access to;
- impersonate anyone, or use the platform for anything unlawful.
We may suspend or close an account that breaches this section. Where it is reasonable to do so, we will warn you first and give you a chance to put things right.
7. Content and intellectual property
Course materials, the website, and the Kalima name and logo belong to us or to our licensors. You may use the materials for your own learning; you may not republish, sell or distribute them.
Work you submit — questions, exercises, projects — stays yours. You give us permission to store and display it as far as we need to in order to run the service and support your learning. If you would rather we did not keep it after your account closes, say so and we will delete it.
Parts of the platform are built on open-source software, including Moodle, which is distributed under the GNU General Public License. Those components remain under their own licences.
8. Availability
We work to keep the platform available, but we do not promise uninterrupted service. We may take it down for maintenance, and we will give notice beforehand where we reasonably can. If a fault of ours prevents a booked session from happening, that session is rescheduled or refunded under section 4.
9. Liability
We provide the service with reasonable care and skill. So far as the law allows, we are not liable for indirect or consequential loss, lost profits, or loss of data that we could not reasonably have foreseen, and our total liability to you is limited to [LIABILITY CAP, e.g. fees paid in the previous N months]. Nothing here limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud. [CONFIRM WORDING WITH COUNSEL]
Kalima teaches skills; it does not guarantee a particular result, a grade, a qualification or a job.
10. Changes to these terms
We may update these terms. The new version is posted here with a new date at the top. If a change affects you materially, we will tell you by email before it takes effect, and you may close your account if you do not accept it.
11. Governing law
These terms are governed by the law of [JURISDICTION], and disputes are heard by the courts of [COMPETENT COURTS]. If you are a consumer, you keep the protection of the mandatory rules of the country where you live.
12. Contact
